WILDE™  INSIGHTS E-COMMERCE TERMS & CONDITIONS


FORMAL AGREEMENT OF SALE


Simply adding a product into a shopping basket or adding it to a wish list does not constitute an agreement of sale. A formal agreement of sale requires completing the entire purchase cycle, which means you’ve electronically submitted a completed order for one or more products or services in your shopping basket and completed payment in full, either online by way of an authorised credit card transaction, transaction via Paypal or other authorised merchants, or by way of cleared Electronic Funds Transfer (EFT) into Wilde™ Insights’ bank account.


CANCELLATION & REFUND POLICY


Wilde™ Insights reserves the right to refuse to accept or process payment on any order should fraud be suspected, without giving any reasons. In this instance Wilde™ Insights would be liable to refund any monies already paid and accepts no liability as a result of such refusal.

Should you be dissatisfied with any product purchased by you on the website due to defect or incorrect choice of products, you may, under certain circumstances, be entitled to either be refunded or have the product repaired, replaced, deferred or rescheduled as the case may be. The Refund Policy regulates your rights in this regard.


Workshops:


Cancellation by Wilde Insights


In the unlikely event that Wilde™ Insights may be required to cancel or reschedule a Master Class (Public workshop or Corporate In-house workshop), Wilde™ Insights reserves the right to do so. In such event, participants will be notified as soon as possible in writing and / or telephonically. In the event of such cancellation, participants may opt to have all pre-paid fees or deposits refunded in full or credited towards a future Master Class (which are scheduled on a regular basis).


Cancellation by delegate


1. Where a delegate wishes to cancel their attendance for whatever reason, the delegate’s deposit or course fees shall be refunded in full provided at least 14 calendar days notice is given in writing, prior to the scheduled commencement date of the Master Class.

       Or, the delegate may request that Wilde™ Insights hold the deposit or fees paid and transfer attendance to a Public Master Class to be held at a future date.

2. In the event that a delegate cancels their attendance less than 14 calendar days prior to commencement of the Master Class, but no less than seven (7) working days prior to that date, the following conditions apply:

a. Delegate’s that paid a 50% deposit shall forfeit that deposit.

b. Delegates that paid their Master Class / Workshop fees in full shall forfeit 50% of the full purchase price of the Master Class... therefore any delegates that received an early payment discount, shall forfeit more than 50% of the amount paid, the value of which shall be dependent on the value of the discount offered to the delegate at the time of purchase. (E.g. If the full price of the Master Class is R2,500.00 and the delegate received a 10% discount for early payment (R250.00), the amount forfeited is 50% of R2,500.00 not 50% of R2,250.00.)

c. Delegates may transfer their registration to another delegate that has not already booked on the program/Master Class and will receive a full refund once the transferring delegate has paid their fees in full.

3. In the event that a delegate cancels their attendance less than seven (7) working days prior to commencement of the Master Class, all fees paid are non-refundable, unless:

a. The delegate transfers their registration to another delegate that is not already booked on the program/Master Class, in which case they will receive a full refund once the transferring delegate has paid their fees in full.

4. Delegates that do not show on the date that the Master Class commences are liable for full payment... all fees paid are therefore non-refundable.


E-Books, Audio or Video downloads


All downloadable orders cannot be cancelled once purchased.


Downloads


Due to the many variables that could render downloadable products or the link thereto problematic or defective, the fact that it is not possible to return a defective link or E-Book to Wilde™ Insights for inspection, and the resultant difficulty in proving the existence or cause of any defect, any alleged defect in downloadable product or Link shall be dealt with as follows:


  • Any problems in using the link to access the downloadable product or in opening, reading, viewing, listening to or using the product itself, or, although able to open the product it is defective or incomplete in any way, please report the problem to Wilde™ Insights within 7 days by way of emailing us at support@wilde-insights.co.za
  • If reported within 7 days, Wilde™ Insights will assist you in determining the possible cause/s of the problem and how to rectify same. No refunds shall be issued unless Wilde™ Insights, in its sole discretion, determines that a refund is appropriate.
  • It should be noted that it will be highly unlikely that Wilde™ Insights deems a refund appropriate if you have already downloaded the product. However, if you believe an error has been made in your purchase and you’ve accidentally ordered the incorrect product, please report the problem to Wilde™ Insights BEFORE clicking on the link to download the product.
  • As it is not physically possible to return a downloadable product or link thereto, no refunds will be given in respect of non-defective downloadable products or links thereto.

Defective or Damaged products


  • If a defective product is received, you are to return the product to Wilde™ Insights in its original packaging, where upon receiving said defective product, Wilde™ Insights shall dispatch a new product to the delivery address stated on your purchase receipt.
  • In the event that the product is out of stock, Wilde™ Insights shall refund your purchase in full.
  • If a defective product was ordered pursuant to a “Special Offer” and such product is no longer being offered at the special price, Wilde™ Insights will refund the full purchase price paid.

Please note: the following will NOT be regarded as defects and will not entitle you to any repair, replacement or refund:


  • Faults resulting from normal wear and tear
  • Links that are inaccessible due to

You not having an internet connection, or if the E-Book is blocked by a firewall, or a similar internet or network related restriction is present on your end.

You having clicked on the link more than 3 times.

  • The inability to open or read an E-Book pdf file on more than one device simultaneously or due to the related Adobe Digital Editions Reader (“Adobe Reader”) being faulty or defective on a device which you have not yet associated or registered with Adobe Reader; or because you are unable to associate your device with Adobe Reader because you are not connected to the internet
  •  

PROCESSING OF REFUNDS

Should you be entitled to a refund for any reason:


  • In the case where payment was made via a credit card, the refund payment will be effected on the same credit card.
  • In the event that payment was made via Electronic Funds Transfer, the refund will be processed by way of Electronic Funds Transfer into the bank account as reflected on Wilde™ Insights records. Refunds will not be made into a third party bank account.

PRICES


All prices and discounted prices are displayed with the product listing. Wilde™ Insights shall take reasonable efforts to ensure prices are correctly reflected at all times however, should a product be erroneously offered at an incorrect price:

  • If the price paid for the product purchased is higher than the correct price, Wilde™ Insights shall refund the amount by which payment exceeds the correct purchase price.
  • If the price paid for the product purchased is lower than the correct price, Wilde™ Insights reserves the right to cancel the transaction or request that the full purchase price be paid before making delivery of the purchase

o   In the even that you choose not to pay the full / correct purchase price for the product, Wilde™ Insights shall refund your payment in full.


METHODS OF PAYMENT


Payment for any products ordered from Wilde™ Insights must be made to the Wilde™ Insights bank account in any one of the following ways:

Credit card payments

At the time of placing an order, transaction details are presented to the bank and an authorization is obtained for the amount of the order. Payment is collected as soon as authorisation is given. Failing such authorisation the order will be cancelled.  

Electronic Funds Transfer (EFT)

Should you choose to pay via EFT (South Africa only)


  • Wilde™ Insights bank account details will be provided on your invoice.
  • The exact amount must be paid in full.
  • Your payment must be accompanied by a reference that uniquely identifies you as the person making the payment.
  1. Where a unique reference or reference number is provided to you by Wilde™ Insights, please ensure that you use that reference when making payment.
  2. Where a unique reference or reference number is not provided by Wilde™ Insights, please use your full name as a reference.
  • Proof of payment must be emailed to Wilde™ Insights in order to reserve your order or booking.

When purchasing a downloadable product, your download link will be provided once the funds have cleared in Wilde™ Insights bank account.

      • If you are making payment from any bank account other than First National Bank, funds will take two – three working days to clear unless you specifically request your bank to clear these funds immediately, which most banks will do for a nominal fee, provided you instruct the bank to do so when processing the EFT.

When making a booking on one of our Workshops / Master Classes, EFT payments that have not cleared within three working days will result in your booking being cancelled.


Please note: Wilde™ Insights does not accept transfers from ATM's; cash or cheque deposits


DELIVERY


Downloadable Products


Upon receipt or clearance of payment, Wilde™ Insights will deliver a link to your downloadable product via e-mail.

The speed of delivery of a link will depend on a variety of factors, most of which are internet related and beyond Wilde™ Insights control (such as server availability, ADSL lines etc.) and as such, Wilde™ Insights does not hereby undertake to make delivery within any specific timeframe. However, as a guide only, delivery should occur within a few minutes, but can also take up to a number of hours.


You will be able to access and click on the link at any time following delivery thereof to you, subject to the following:


  • You will only be able to click on such link a maximum of 3 times, thereafter, to prevent fraud, your access to the link will be blocked.
  • The link will not appear if you have removed it.
  • Access to download the product/s purchased will be made available to you for a period of 30 days, where after access will no longer be granted.

PRACTICALITIES WITH REGARD TO DOWNLOADS


The link will contain a unique reference number and by clicking on the link you should be able to access your download.

If you have any problems relating to the functionality of your link, please report same to Wilde™ Insights via email and we will attend to your enquiry within 24 hours.


DELIVERY CHARGES


Downloadable Products


Wilde™ Insights does not charge any delivery fees for electronic delivery of downloadable products.

However, there may be associated costs for you to download these products through your Internet Service Provider and/or Telecoms provider and Wilde™ Insights will under no circumstances be liable for any such costs incurred by you.

Please note that when downloading E-books, Audio and Video files, these can be very large, depending on the product you have purchased, so if there is a cap on your monthly data usage, make sure that you have sufficient data usage available to you from your ISP to download these files.


Delivered Products


All products sold by Wilde™ Insights are only downloadable, therefore shipping charges do not apply.


PRIVACY


We take your privacy very seriously and unless expressly requested by you, under no circumstances will we pass your personal information on to third parties. Wilde™ Insights takes all reasonable steps to protect your personal information.

Wilde Insights may electronically collect, store and use the following personal information for internal use only (this information is collected electronically using cookies or is provided voluntarily by you):


  • Name and surname
  • Birth date
  • Gender
  • Country of residence
  • City
  • Browsing habits and click patterns
  • E-mail address
  • IP address
  • ID number or passport number

Wilde™ Insights collects, stores and uses your personal information for the following purposes:


  • To recognise and greet you when you access the website.
  • To authenticate you as an authorised user of our products and services.
  • To inform you of facts relating to your access and use of the website subject to your consent
  • To inform you of new products or special offers from Wilde™ Insights and or any partners or affiliates subject to your consent.
  • To compile non-personal statistical information about browsing habits, click-patterns and access to the website.
  • To ensure that the goods are received by the addressee.

SECURITY


Any person that delivers or attempts to deliver any damaging code to this website or attempts to gain unauthorised access to any page on this website shall be prosecuted and civil damages shall be claimed in the event that Wilde™ Insights suffers any damage or loss.


You agree and warrant that your log-in name and password will:


  • Be used for your personal use only and not be disclosed to any third party
  • You allow Wilde™ Insights to take all reasonable steps to ensure the integrity and security of the website, its products and back-office applications.

All credit card transactions are secure socket layers (SSL) encrypted.


COPYRIGHT OF E-BOOKS, AUDIO OR VIDEO DOWNLOADS


All downloads are the exclusive property of the publisher or its licensors and is protected by copyright and other intellectual property laws. The download of E-Books audio or video files is intended for your personal and non-commercial use. Any other use of the downloads purchased from Wilde™ Insights is strictly prohibited. Downloads may not be modified, transmitted, published, reproduced, sold, distributed, in whole or in part and you are prohibited from lending downloads to any other person. By downloading an order from Wilde™ Insights you hereby acknowledge and agree to these terms. You hereby undertake to not be involved in any of the above illegal activities.


CHANGES TO TERMS & CONDITIONS (T&C)


Wilde™ Insights may at their discretion change these T&C or any part thereof at any time with or without notice. To this end it is your responsibility at all times to ensure that you are satisfied with the T&C.


INTELLECTUAL PROPERTY


All content, trademarks and data on this website, including but not limited to, software, databases, text, graphics, icons, hyperlinks, private information, designs and agreements, are the property of or licensed to Wilde™ Insights and as such are protected from infringement by local and international legislation and treaties.


COMMUNICATION


In visiting the website or sending communication to Wilde™  Insights you consent to receiving electronic communications from Wilde™  Insights and agree that all agreements, notices, disclosures and other communications sent by Wilde™  Insights satisfy any legal requirements, including but not limited to the requirement that such communications should be "in writing."
